1. GENERAL PROVISIONS

  1. The website www.fill.com.pl operates under the terms specified in these Terms and Conditions.
  2. The Terms and Conditions specify the types and scope of services provided electronically by the website www.fill.com.pl, the rules for providing these services, the conditions for concluding and terminating agreements for electronic services, as well as the complaint procedure.
  3. Each Service Recipient, upon commencing activities aimed at using the Electronic Services of the website www.fill.com.pl, is obliged to comply with the provisions of these Terms and Conditions.
  4. In matters not regulated by these Terms and Conditions, the provisions of the following apply:
    1. The Act on Providing Services by Electronic Means of July 18, 2002 (Journal of Laws No. 144, item 1204, as amended),
    2. The Consumer Rights Act of May 30, 2014 (Journal of Laws 2014 item 827),
    3. The Civil Code Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended), and other applicable Polish legal provisions.

2. DEFINITIONS

  1. CONTACT FORM – a form available on the website www.fill.com.pl allowing the Service Recipient to directly contact the Service Provider.
  2. TERMS AND CONDITIONS – these terms and conditions of the website.
  3. SERVICE PROVIDER – FILL Spółka z ograniczoną odpowiedzialnością, registered office address: ul. St. Staszica 7, 32-640 Zator, correspondence address: ul. St. Staszica 7, 32-640 Zator, NIP: 5492472516, REGON: 525211093, registered in the Central Registration and Information on Business, email address: marketing@fill.com.pl, phone: +48500455326.
  4. SERVICE RECIPIENT – a natural person, legal person, or an organizational unit without legal personality, to which the law grants legal capacity, using the Electronic Service.
  5. ELECTRONIC SERVICE – a service provided electronically by the Service Provider to the Service Recipient via the website.

3. TYPES AND SCOPE OF ELECTRONIC SERVICES

  1. The Service Provider enables the use of Electronic Services via the website such as:
    1. use of the Contact Form,
  2. The provision of Electronic Services to Service Recipients is based on the conditions specified in the Terms and Conditions.

4. CONDITIONS FOR PROVIDING AND CONCLUDING AGREEMENTS FOR ELECTRONIC SERVICES

  1. The provision of Electronic Services specified in Chapter III, point 1 of the Terms and Conditions by the Service Provider is free of charge.
  2. The duration for which the agreement is concluded:
    1. The agreement for the provision of the Electronic Service consisting of the possibility of sending a message via the Contact Form is concluded for a definite period and is terminated upon sending the message or ceasing to send it by the Service Recipient.
  3. Technical requirements necessary to cooperate with the ICT system used by the Service Provider:
    1. a computer with Internet access,
    2. access to email,
    3. an internet browser,
    4. enabling Cookies and Javascript in the web browser.

The Service Recipient is obliged to use the website in accordance with the law and good manners, respecting the personal rights and intellectual property rights of third parties.

The Service Recipient is obliged to provide data consistent with the actual state.

The Service Recipient is prohibited from providing unlawful content.

5. COMPLAINT PROCEDURE

Complaints related to the provision of Electronic Services by the Service Provider:

Complaints related to the provision of Electronic Services via the website can be submitted by the Service Recipient via email to: marketing@fill.com.pl.

The email should include as much information and circumstances regarding the subject of the complaint as possible, especially the type and date of the irregularity and contact details. Providing detailed information will significantly facilitate and expedite the complaint process by the Service Provider.

The Service Provider will address the complaint promptly, no later than within 14 days.

The Service Provider’s response to the complaint will be sent to the Service Recipient’s email address provided in the complaint or in another way provided by the Service Recipient.

6. INTELLECTUAL PROPERTY

All content posted on the website at www.fill.com.pl is protected by copyright and is the property of www.fill.com.pl. The Service Recipient bears full responsibility for any damage caused to the Service Provider as a result of using any content of the website www.fill.com.pl without the Service Provider’s consent.

Any use of any elements comprising the content and content of the website www.fill.com.pl without the express written consent of the Service Provider constitutes a violation of the copyright belonging to the Service Provider and results in civil and criminal liability.

7. FINAL PROVISIONS

Agreements concluded via the website are concluded in accordance with Polish law.

In the event of any part of the Terms and Conditions being inconsistent with applicable law, the relevant provisions of Polish law shall apply in place of the challenged provision of the Terms and Conditions.
